Terms of Service

Last updated: 15 August 2026

These Terms of Service (“Terms”) govern your access to and use of the TenderCity platform, operated by CloudNala (Pty) Ltd (registration number 2023/851288/07), a company incorporated in the Republic of South Africa. By registering for or using the platform, you agree to be bound by these Terms.

1. The service

TenderCity provides a procurement intelligence platform that aggregates public tender and award data from South African government sources, enriches it with AI-generated analysis, and provides tools for procurement professionals to discover, evaluate, and respond to procurement opportunities.

2. Eligibility and accounts

To access TenderCity, you must:

  • Be a legal entity or individual of at least 18 years of age operating in a professional capacity.
  • Provide accurate account information and keep it up to date.
  • Maintain the security of your account credentials. You are responsible for all activity under your account.
  • Notify us immediately through our contact page if you suspect unauthorised access.

3. Plans, credits, and payment

TenderCity is offered on the plans described on our Plans & pricing page. Specifically:

  • New accounts start on a 30-day free trial with an included credit allowance — no card is required to start a trial.
  • Analysis features (document intelligence, go/no-go, bid coach, and similar) consume credits from your account’s credit balance on a per-use basis.
  • Credits can be purchased at any time as a one-off top-up. Top-ups are once-off purchases, not a recurring subscription — we do not store your card details and do not charge your card again without a new, explicit checkout.
  • Paid plans (Starter, Team) grant a monthly credit allowance for the period you’ve paid for; continuing onto a new period requires a new checkout, not an automatic renewal charge.
  • All prices are quoted in South African Rand (ZAR).
  • Payments are processed by Yoco, a licensed South African payment service provider. We do not have access to your full card details.
  • Purchased credits do not expire. Refunds for unused credits are considered on a case-by-case basis — contact us through our contact page.

4. Acceptable use

You may use TenderCity only for lawful purposes and in accordance with these Terms. You agree not to:

  • Scrape, harvest, or systematically extract data from the platform beyond what is permitted by your plan.
  • Use the platform for any purpose that violates South African law, including the Promotion of Access to Information Act (PAIA) or competition law.
  • Attempt to gain unauthorised access to the platform’s systems or other users’ accounts or tenants.
  • Share your account credentials with third parties or resell access to the platform outside of an authorised Partner arrangement.
  • Use automated tools to access the platform in ways that degrade service for other users.
  • Upload documents you do not have the right to upload, or that contain unlawful content.

5. Data accuracy and AI-generated content disclaimer

TenderCity aggregates publicly available procurement data and enhances it with AI-generated analysis. While we take reasonable steps to ensure data quality:

  • Tender and award information is sourced from third parties and may contain errors, omissions, or delays.
  • AI-generated insights — go/no-go scores, win-probability estimates, document analysis, and drafted response content — are informational only and do not constitute professional procurement, legal, or financial advice.
  • You are solely responsible for verifying information with official sources and for any bid decisions or submissions made based on TenderCity output.
  • The platform is not affiliated with any organ of state, the National Treasury, CIDB, or any government body unless explicitly stated.

6. Intellectual property

The TenderCity platform, including its design, software, and proprietary data compilations, is owned by CloudNala (Pty) Ltd (registration number 2023/851288/07) and protected by South African intellectual property law.

Publicly sourced tender data is not owned by TenderCity. You may use platform data for your own business purposes but may not republish, resell, or create derivative products from our data compilations without written permission.

7. Limitation of liability

To the maximum extent permitted by South African law:

  • TenderCity is provided “as is” without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including any tender bid outcome.
  • Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.

8. Termination

You may cancel your account at any time through your account settings or by contacting us. Cancelling stops future charges — it does not refund unused credits, which are handled per section 3.

We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required by law. We will provide reasonable notice where possible.

9. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the South African courts.

10. Changes to these Terms

We may update these Terms from time to time. We will notify users of material changes with at least 14 days’ notice by email or platform notification. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
